Carrington Contested Litigation Foreclosure Analyst in Anaheim, California

The Contested- Litigation Foreclosure Analyst is responsible for the end-to-end servicing and processing for the overall servicing of an assigned case load of contested foreclosure actions in accordance with applicable state, insurer, and investor foreclosure requirements, including the management of the discovery process. Monitors the overall performance, productivity and exception management resolution for attorney vendors assigned to the contested foreclosure unit. The analyst will support other related mortgage servicing functions and lines of business and works closely with other internal and external team members and business partners on all tasks associated with a timely and accurate processing and servicing of all assigned cases and portfolios. Perform all duties within company policies and procedures and all state and federal regulations. The target pay range for this position is $25.00 - $28.00/hr.

What you’ll do:

  • Manages the discovery process, including review and response to inbound discovery requests, and ensures the correct handling of confidential and sensitive company information identified as attorney-client privilege during any and all related processes to the foreclosure discovery workflow.

  • Manages approval or denial of attorney fee invoices up to delegated authority.

  • Facilitates case settlements where beneficial to the company and/or investors.

  • Collaborates and communicates with servicing business units to ensure optimal resolution and/or outcome of foreclosure cases.

  • Ensures timely and accurate completion of all regular scheduled case management steps including outstanding /late steps within the foreclosure tracking software on a daily basis, and keeps contested foreclosure actions moving forward to resolution.

  • Consult with and interact with law offices and investors regarding all processes throughout assigned foreclosure actions in accordance with company policies.

  • Provide law firms with all evidence, judgment figures, affidavits, proposed discovery responses and other documents as needed throughout the course of litigation; image and upload all documents received by law firms and other departments to the foreclosure tracking software as needed in a timely manner; and use conflict resolution skills to conciliate disputes.

  • Manages and monitors all collateral file custodian requests on assigned foreclosure actions as needed for trials, depositions, or other hearings.

  • Assists with analysis and approval of case settlements, attorney invoice requests, and additional approvals as needed above delegated authority level; assists with preparing assigned foreclosure actions for depositions, trials, mediations, or other hearings as needed.

  • Properly maintains system of record and/or foreclosure tracking software in compliance with company notification and reporting policies during a contested foreclosure action; documents all servicing, action taken, delays, follow-up, and phone conversations in the system of record.

  • Monitors vendor performance and properly notify Department Manager, Vendor Management, Oversight Management, or Client Management when performance issues occur (vendor’s inability/failure to comply with CMS/investor/insurer policies); review, analyze, and evaluate assigned foreclosure actions for escalations to external litigation firms.

  • Communicates and collaborates with other servicing business units as needed, and ensures lawsuits or counterclaims filed against the company or investors are transferred to the in house legal department to manage.

  • Strong knowledge of the foreclosure end to end servicing process for mortgage loans.

  • Working knowledge of the state and federal rules of civil procedure.

  • Strong knowledge of relevant and industry specific computer systems and software packages.

  • Strong written and verbal communication skills, ability to express or exchange ideas by means of the spoken word, communicating orally with others accurately.

  • Negotiation skills that allows the analyst to conduct and manage a call with a vendor and to come to a proper resolution for both the company and the vendor.

  • Ability to understand complex foreclosure issues and to collaborate with vendors to arrive at a solution.

What you’ll need:

  • Bachelor’s degree or equivalent work experience or State Certified Paralegal.

  • A minimum of five (5) years’ experience in the Banking and/or Mortgage industries, or relevant work experience.

  • Two (2) years of Foreclosure experience

  • Notary Public and prior management or leadership experience desired.
