Direct Care and Treatment (DCT) is seeking an individual to join our DCT General Counsel’s Office for an exciting and rewarding opportunity as an Associate General Counsel! This position will provide legal advice and related services primarily to the Minnesota Sex Offender Program (MSOP) and other DCT divisions. This position will provide legal advice in a variety of complex and changing areas, applicable to the diverse activities of DCT divisions and facilities. Specifically, the individual provides legal advice on issues including, but not limited to, the Minnesota Commitment and Treatment Act; Sexually Dangerous Persons and Sexual Psychopathic Personalities; data privacy; protected health information; legal review of policies; reductions in custody; hearings before the Commitment Appeals Panel (CAP); and matters pertaining to SDP/SPP commitments before the Special Review Board.
Primary Responsibilities:
Provide legal advice and related services to MSOP leadership, management, and staff and to other DCT divisions directed by supervisors in the General Counsel’s Office.
Provide legal advice and services related to proposed legislative changes affecting MSOP.
Maintain knowledge of MSOP operations and departments.
Coordinate claims against and litigation affecting MSOP, including state and federal litigation.
Conduct legal review of MSOP and DCT policies to ensure consistency with other DHS and DCT policies, applicable statutes, rules, regulations, licensing requirements, and regulatory standards.
Develop and conduct trainings on legal policies.
Minimum Qualifications
JD degree from an ABA accredited law school;
Current license and in good standing to practice law in Minnesota;
Three (3) years’ experience as a practicing attorney in civil commitment, health care, privacy, or a related field. Experience must demonstrate the following:
Experience providing legal advice interpreting rules, laws, court orders and other legal and/or regulatory materials.
Experience with the legislative process and federal and state laws.
Preferred Qualifications
Possess knowledge of state and federal law, rules, and regulations relating to the Minnesota Commitment and Treatment Act, the Minnesota Uniform Probate Code (specifically the Minnesota Guardianship Act), the Minnesota Health Records Act, the Minnesota Vulnerable Adults Act, the Minnesota Maltreatment of Minors Act, the Health Insurance Portability and Accountability Act, and the Minnesota Government Data Practices Act.
Experience identifying statutes and rules that apply to individual situations and experience advising decision-makers of the legal consequences for actions or failures to act in compliance with applicable statutes and rules.
Experience determining the impact of proposed or adopted changes in state or federal law, rule or regulation that impact a treatment facility or program.
